“What is the Role of a Workers’ Compensation Judge as Related to My Claim?”

Sometimes a worker who has an injury will have difficulty acquiring medical treatment or getting paid while unable to work, and your issue may be listed in front of a workers’ compensation judge.  What does the workers’ compensation judge do?

A workers’ compensation judge will address disputes related to issues of access to medical treatment and pay while receiving care.  The judge will decide if the insurance company should pay, and the judge is the only person making such decisions.

If you have lost your job, the workers’ compensation judge cannot do anything to resolve that problem.  Similarly, issues regarding lost vacation or sick time are not matters addressed there.  They would need to be pursued in another venue.
