RECOVERING ASSOCIATION DUES FROM THE DELINQUENT UNIT OWNER

Are you a board member of a community association or property manager of a community association? Have you noticed that there’s a difficulty in collecting outstanding dues from unit owners? If any of these items are true or properly describe your community association, there are a multitude of things that you and the association can do to enforce the rights of the association.

For instance, a letter advising the unit owner that they’re a) delinquent in their payments of association dues and b) if they remain delinquent the matter will be referred to counsel is a good first step in collecting the “low hanging fruit” the unit owners that mean to pay but simply forgot to pay or are having some financial difficulty but want to do enter into a payment arrangement before a lawsuit.

In conjunction with this letter, the application of late fees to each month the unit owner is delinquent in their monthly payments is also appropriate if allowed by your association’s governing documents and may encourage a unit owner to begin paying the outstanding association dues in order to avoid a late fee.

Keep in mind that many governing documents require: 1) that the unit owner pay their association dues on time and 2) Allow the association to apply late fees to delinquent unit owner accounts, rescind right of unit owners, which include but is not limited to, preventing these unit owners from voting at elections, running for board positions, the towing of the unit owners vehicle, prevention of unit owners from using common elements and various other avenues that can be handled prior to any collection effort.

If the unit owner is still non responsive after each of these aspects of the matter are attempted, then the appropriate action is to refer the matter to a law firm. The law firm can then, pursuant to the Fair Debt Collection Act, send a letter to the unit owner advising them of the delinquency and telling them that if they fail to respond in a certain period of time they will be subject to penalties such as liens being placed on their property and lawsuits being filed against them for the collection of the amounts owed and due at the time. Additionally, many governing documents also require the unit owner in collection to pay legal fees incurred by placing the matter into collections.

If you are not a citizen and you are injured at work, you may be concerned about what your citizenship status means in relation to your access to benefits for your injury.  The answers hinge both on whether you are here legally and what types of benefits you are seeking.

You have been injured, and you can’t work.  You’re waiting for Social Security disability benefits, but the process takes a long time.  You need income now, and you are wondering if applying for unemployment benefits would be at least a temporary solution.  Unfortunately, this is usually not a viable option.

The main problem with this in New Jersey is that you have to sign a form stating you are ready, willing and able to work.  If you are ready and able to work, it begs the question of how you can be disabled, and a Social Security administration judge is going to ask that same question if you apply under such circumstances.

There are, however, some exceptions which may allow you to be eligible for unemployment benefits at the same time as Social Security disability benefits.  In particular, Social Security’s own guidelines do not consider you employed if you are earning less than $1,040 per month in the year of 2013-2014.  You may then be eligible to receive unemployment benefits, buy you should speak to an attorney specializing in Social Security disability before applying.

Perhaps you have just recently been injured, or perhaps you have been injured and unable to work for a while, and you are wondering at what point you should apply for Social Security Disability.  The answer is that you need to apply for these benefits immediately once you and your doctor determine you will not be able to return to work due to your injury.

In order to qualify for Social Security Disability benefits, you and a doctor must agree that you have a disability that is going to prevent you from returning to work.  It can take a long time for you to acquire your benefits.  The law indicates specifically that you must be unable to work for at least six months, and a doctor must indicate you will be out of work for at least a year.  If you are not working, and you are not receiving benefits, it is important to apply now because the process can take so long.  It is important to take the steps now to protect yourself.

Considering the expenses that can follow the unfortunate event of an accident or injury, it may not seem like the most convenient time to invest your money in hiring an attorney.  Fortunately, in New Jersey lawyers have a responsibility to potential clients to offer choices of payment options from which a client can select based on convenience.

Most often, clients choose to pay on a “contingency fee agreement”.

This means you do not pay any money up front, and you do not pay by the hour.  Instead, you would pay the attorney in the event the attorney is successful in recovering money for you, and the percentage is set by the Supreme Court.

Some clients do choose to pay based on an hourly rate, and other clients elect to pay based on a “mixed fee agreement”, which is a combination of an hourly rate agreement and a contingency fee agreement.  With this choice, whatever fee you pay at an hourly rate is credited toward the ultimate contingency fee payment.

It is important to note that costs such as obtaining medical records, filing complaints, having doctors testify, mailing fees, and similar expenses are always paid for by the client, and your attorney will always give you the choice whether or not to pursue these options.  Some of these costs can be extraordinary in certain cases, so it is important to be aware that you will be responsible for these.

In July I told you the story of Forever 21 versus the Garage and Rachel’s, or should I say my, shopping experience.  More recently, I attended a business conference and wound up getting stuck as a result of mechanical difficulties.  12 hours stuck.  What I found interesting was the original attendant at the airlines didn’t know her product, really how to help me or anyone else there, and in an attempt to assist me by switching flights wound up placing me last on the stand-by list.  I assured the next attendant that I had no influence over the prior attendant nor their computer system and was told there was nothing that could be done and I would remain in last place.

Quickly, having at this point waited 5 hours, requested to speak with a supervisor.  The supervisor came and saved the day by placing me at No. 1 in the standby line.  This did not help.  I had to wait another 7 hours in order to get onto the redeye flight.  However, the supervisor also indicated that I could reserve a confirmed seat on the redeye and still try for standby; an option that had not previously been made known.

The conclusion I drew from this experience is that it is critical to know what it is that you do, what your product is and how to provide great quality customer service.  All of these ah hah moments are translatable into how we are forever attempting to move Gaylord Popp and our culture as a firm to address these exact customer service issues.

In the same trip, I had the opportunity to listen to the owner of Zappos describe a company culture where people understand that they aren’t in the shoe business but are in the making people happy business.  When I came back from my trip, I met with all of our attorneys and staff to describe how we are going to become the Zappos of law firms.  Our vision is to make our clients happy.  It may sound simple or understated but we believe if executed as we envision it will be the most significant firm culture shift we have had in a long time.  We are excited for this journey and invite you to join us.  I would love to hear about your experiences with our firm good or bad, preferably bad, and if you would take the time to send me an e-mail at sgaylord@gaylordpopp.com it would be greatly appreciated.

You should not sign a release from the insurance company within several weeks after you are injured in an accident.

The insurance company sent this release form to you in an attempt to have you waive your right to sue the other driver.  You should not sign that release because you may still be in pain, and you may not know the full extent and nature of your injuries.

You don’t know how bad your condition will be in the future as a result of the accident, and the treatments you may require are also unknown.  You may have an undiagnosed injury that may require future surgery.  Your current condition may worsen as a result of the accident.  You need to take into consideration the possibility of future damages including future pain and suffering, lost wages, and disability.  If you sign the insurance company’s release form before you have a full understanding of the extent of your injuries, you are taking a large gamble with your well-being.
